Preparing for Potentially Expanded BIPA Exposure After the Meta Decision

Companies that collect voice data may face heightened risk related to Illinois’ Biometric Information Privacy Act (BIPA) following a recent Northern District of California decision. In Delgado v. Meta Platforms, Inc., the court focused on Meta’s alleged ability to convert voice recordings into biometric data and use that data to identify an individual, rather than on whether Meta had actually taken either step. That reasoning may provide plaintiffs with a new avenue for challenging AI voice-processing technologies and could result in more complex and costly BIPA litigation. With insights from experts at Baker Donelson, Blank Rome, KamberLaw and Lewis Brisbois, this article explores the court’s reasoning, the decision’s key takeaways and the compliance measures companies can adopt to strengthen their defenses and mitigate risk. See “BIPA Litigation Dynamics Following Seventh Circuit Clay Decision” (May 20, 2026).
